Terms of Service

1. Account and authority

You must provide accurate account information and have authority to accept these Terms for yourself or your organization.

2. Customer content

You retain ownership of data, prompts, files, media, instructions, outputs, and other content you provide or generate. You grant ShoonyaAI the limited rights needed to host, process, secure, support, and provide the services, subject to the Data and Model Training Addendum below.

3. Your responsibilities

You must have all rights, permissions, notices, and lawful bases needed to submit content. Do not submit illegal content, secrets you are not authorized to disclose, or regulated or sensitive personal data unless ShoonyaAI has agreed in writing to process it.

4. AI outputs

Outputs may be inaccurate or non-unique. You must review outputs before relying on or publishing them, and you remain responsible for your use.

5. Acceptable use

You may not misuse the services, evade safeguards, violate law or third-party rights, or use outputs to make prohibited high-impact decisions without appropriate human review.

6. Connected accounts

You may connect third-party accounts such as Instagram, Facebook, WhatsApp, YouTube, TikTok, LinkedIn, or X. You must own or be authorized to manage each account you connect, and your use of each remains subject to that platform’s own terms. ShoonyaAI publishes content only at your instruction. We never ask for or accept your password for a connected platform.

7. Fees and credits

Paid usage is prepaid and pay-as-you-go. Credits are consumed according to the product meter shown at purchase and are not currency.

8. Confidentiality and security

Each party will protect the other’s confidential information using reasonable safeguards. No internet service is guaranteed to be completely secure or uninterrupted.

9. Suspension and termination

ShoonyaAI may suspend misuse or material breach. You may stop using the services at any time. Legal retention, deletion, and export requests are handled subject to applicable law and contract.

10. Disclaimers and liability

The services are provided as available. To the maximum extent permitted by law, implied warranties are disclaimed and liability is limited to fees paid in the preceding twelve months.

11. Governing law

These Terms are governed by the laws applicable in Delhi, India, subject to mandatory consumer law.

Operational processing

Applies to every tier. ShoonyaAI may process customer content to provide requested features, prevent abuse, maintain security, diagnose failures, provide support, comply with law, and calculate usage.

Free tier

The free tier is subsidized partly through model improvement. After conspicuous acceptance, ShoonyaAI may use eligible customer prompts, content, data, feedback, and derived signals to train, evaluate, and improve models and services that may benefit other customers. Do not use the free tier for confidential, sensitive, regulated, or third-party data that you are not authorized to contribute for this purpose. A user may withdraw from future training use by upgrading or contacting ShoonyaAI; withdrawal does not require unlearning from models already trained where technically or legally infeasible.

Paid tier

Paid customer data is not used to train models for other customers unless an authorized workspace administrator separately opts in. Opt-in is voluntary and can be withdrawn for future training runs.

Premium tier

Premium customer data is contractually and technically excluded from training or improving models for other customers. It may only be processed to provide, secure, support, and improve that customer’s own service, unless a separate written agreement expressly states otherwise.

Exclusions

Regardless of tier, ShoonyaAI will not intentionally select authentication secrets, payment-card data, government identifiers, private encryption keys, or content flagged for legal deletion as model-training data. Training eligibility is tenant-scoped, versioned, and auditable.

Data obtained from a connected platform, including Instagram and Facebook, is never used to train models that serve other customers, on any tier.

Changes

Material changes to these rules require a new document version and re-acceptance. The current effective policy is shown in workspace settings.
